Terms of Service & Event Policy
(Richmond, Virginia & Surrounding Areas)
1. Agreement to Terms
By booking services from M.E. Mobile Cigar Lounge (“Provider,” “we,” “our”) or participating in an event, the client and all guests acknowledge they have read, understood, and agreed to these Terms of Service.
These Terms apply to all events, bookings, and interactions with Provider.
2. Nature of Services
M.E. Mobile Cigar Lounge provides a temporary, event-based cigar lounge experience, which may include:

Lounge furniture and seating

Cigar ambiance and setup
-
Guided cigar education by a professional attendant
We do not:

Operate a tobacco retail store
-
Manufacture cigars
-
Sell alcohol
-
Encourage cigar consumption
All services are temporary and removed immediately after the event.
3. Venue Approval & Legal Compliance
The client is solely responsible for:

Obtaining venue approval for cigar use
-
Confirming smoking is permitted in the designated area
-
Ensuring compliance with all local, state, and venue regulations
Provider is not responsible for venue denial, enforcement actions, or penalties arising from lack of approval.
4. Guest Eligibility & Conduct

All guests must be of legal smoking age

Guests must behave in a respectful and lawful manner
-
Provider may suspend or terminate services if guest behavior creates safety, legal, or venue issues
No refunds will be issued for termination caused by guest misconduct.
5. Assumption of Risk
Participation in the cigar lounge experience is voluntary.
Guests understand cigar use carries inherent health risks. Provider offers education only and does not promote or require cigar consumption.
By attending, guests and clients assume all risks associated with participation.
6. Limitation of Liability
To the fullest extent permitted by law:

Provider is not liable for guest health outcomes

Provider is not liable for guest behavior

Provider is not liable for venue rule enforcement

Services are provided “as-is” and “as-available”
Provider shall not be liable for indirect, incidental, or consequential damages.
7. Indemnification
The client agrees to defend, indemnify, and hold harmless M.E. Mobile Cigar Lounge, its owners, staff, and contractors from any claims, damages, or expenses arising from:

Guest actions or misconduct

Failure to secure venue approval
-
Violations of law or venue policies
-
Damage to property caused by guests
8. Insurance
M.E. Mobile Cigar Lounge carries general liability insurance.
A Certificate of Insurance naming the venue as additionally insured may be provided upon request.
9. Property Care & Damage
All furniture and equipment must remain in designated areas.

Burn damage to chairs or furniture: $182 per item
-
Pickup or removal of furniture by guests is prohibited
Client is responsible for damages caused by guests.
10. Travel Fees
-
First 28 miles from Richmond, VA: No charge
-
Beyond 28 miles: $0.82 per mile
11. Event Time & Overage Fees
Events must end at the scheduled time.
Overtime (subject to availability and venue approval):
-
Additional hours up to booked time: $150 + $75 per hour

Hours exceeding double the booking time: $150 + $150 per hour
12. Force Majeure
Provider is not responsible for delays or cancellations due to:

Weather conditions
-
Government regulations
-
Venue restrictions
-
Events beyond reasonable control
13. Media & Promotional Use
Provider may photograph or record events for promotional use unless the client opts out in writing before the event.
14. Website & Content Use (If Applicable)
Any logos, branding, photos, written materials, or content created by Provider may not be copied, republished, or used for commercial purposes without written permission.
Unauthorized use may result in termination of services or legal action.
15. Third-Party Services
Provider is not responsible for services, products, or actions of third parties, including venues, caterers, or entertainers.
Any agreements with third parties are solely between the client and those parties.
16. Right to Refuse or Terminate Service
Provider reserves the right to refuse or terminate service for:

Safety concerns
-
Legal violations
-
Venue noncompliance
-
Policy violations
17. Governing Law
These Terms are governed by the laws of the Commonwealth of Virginia. Any disputes shall be resolved in Virginia courts.
18. Severability & Waiver
If any provision is found unenforceable, the remaining provisions remain valid. Failure to enforce any term does not constitute a waiver
